I. Jurisdiction
MAXTAINMENT.COM (owner: Markus Fruehwirt) provides its services subject to the following conditions. Please note that MAXTAINMENT.COM fulfills your order under the current Conditions of Use.
These Conditions of Use are also subject to all further business relations.
II. Conclusion of an agreement
An order by a customer requires a confirmation.
The shipping of items ordered by a customer concludes an order too.
III. Price
All prices include tax (20 %), unless noted otherwise.
IV. Payment conditions
We accept advanced payment (bank transfer or credit card) only.
Bank transfers are valid upon receipt of payment in our business account, payments by credit card are released immediate after the order was placed and after credit assessement on the part of our payment provider mPay24.
V. Shipping, transportation
Our sale prices don’t include shipping and handling.
Extra costs that arise from deliveries that are not picked up or returned to us due to an incomplete or invalid address, will be allocated to the customer.
VI. Delivery deadline
We are obliged to execute our services as soon as the customer meets all of the necessary requirements.
We reserve the right to extend the agreed dates and delivery deadlines up to one week. Only after expiry of this deadline is the customer able to withdraw from the agreement.
VII. Withdrawal (within the European Union)
Customers may return items within 14 business days (§§ 5a ff Customer Protection Law) of receiving them at their shipping address or in case of services with the day of the contract conclusion. Saturdays don’t count as business days. Possible returns must be announced within this period via eMail or fax.
If the customer returns items according to these conditions, he is obliged to pay the costs for the return.
Unsealed CDs, DVDs, Software or Sanitary Products are ineligible for return respectively when they were shipped without original manufacturer packaging (e.g. DVD-Box) on customer request.
VIII. Warranty
The customer is obliged to check each item within 14 days after receipt. If any defects are detected the customer must notify MAXTAINMENT.COM immediately via eMail or fax.
On demand of MAXTAINMENT.COM the customer must return the defective item including a detailed error report. Accordingly, it will be replaced as soon as possible.
In case a replacement is possible, claims on price refunds or price reductions are not applicable.
IX. Product liability
Recourse demands under the § 12 Product Liability Law are out of the question, unless the customer proves that any failures were caused by MAXTAINMENT.COM.
X. Legal domicile
Austrian law is in effect.
German is the main language.
The use of UN Trade Right is explicitly out of the question.
XI. Data protection
The customer gives his consent for the use of personal data to fulfill the contract and to save them in the database of MAXTAINMENT.COM.
